Project submission form

By proceeding, I confirm that I have read, fully understand, and agree to be legally bound by the Terms and Conditions of Capital Data Recovery Inc., both personally and on behalf of my heirs, successors, administrators, and assigns.

1. Ownership and Authorization
The Client represents and warrants that they are the legal owner, authorized representative, or have legitimate rights to all property and data provided to Capital Data Recovery Inc. The Client authorizes Capital Data Recovery Inc. to perform all necessary evaluations and diagnostics on the submitted media to assess damage and provide a recovery estimate. The Client acknowledges that media may be opened for diagnostic or repair purposes, which may void existing manufacturer warranties.

2. Confidentiality & Non-Disclosure
Capital Data Recovery Inc. agrees to maintain absolute confidentiality regarding all information and data files provided, stored on, or recovered from Client equipment.
No information will be disclosed to any third party without the Client’s express written consent, except as required by law.
A signed copy of this agreement is available to the Client upon request.

3. Limitation of Liability
The Client acknowledges and accepts that data recovery involves inherent risks, including but not limited to, further damage to media or data, inability to recover data, incomplete or inaccurate recovery, and total data loss, even if caused by Capital Data Recovery Inc.’s negligence.
Capital Data Recovery Inc. shall not be liable for any damages, direct or indirect, including but not limited to, loss of data, loss of revenue, incidental or consequential damages, or claims regarding the physical functioning of equipment/media, before, during, or after services are performed.

4. Financial Responsibility
The Client is solely responsible for all shipping costs, customs duties, taxes, and related charges for media sent to or from Capital Data Recovery Inc.
Payment in full is required upon successful data recovery, prior to release of any data.

5. Abandoned Media
Any media not collected within thirty (30) days after the completion or decline of recovery services shall be deemed abandoned and will be permanently destroyed for security reasons, with no further liability to Capital Data Recovery Inc.

6. Minimum Recovery Fees (Non-Refundable)
By signing this agreement, the Client acknowledges and accepts the following minimum recovery fees:
Hard Drive, SSD, RAID (per drive):
Non-Urgent Service: $499
Standard Service: $899
Emergency Service: $3,500
Flash/SD/USB Media:
Logical Recovery: $399
Electrical Issues: $599 + Diagnostic Fee
CD/DVD: $299+

No data, no fee applies only to standard data recovery, not to ransomware, encrypted, or custom projects. For such projects, fees apply regardless of the outcome.
Diagnostic and parts fees are non-refundable. If you require return of original media, specify at project submission. Additional charges may apply for re-assembly.

7. Diagnostic Fees (Non-Urgent Only; Non-Refundable)
Diagnostics are free for Non-Urgent Service except for the following cases:
Previously Opened Media: $500
Fire/Water Damage: $200
Encrypted Media: $500
Non-detectable Digital Media: $100
Western Digital My Passport: $100
Seagate Rosewood: $100
RAID Server/NAS: Contact for pricing
